Medical Negligence Claims for Cosmetic Surgery


The industry's Independent Healthcare Advisory Services (IHAS), has drawn up what is known as The Good Medical Practice in Cosmetic Surgery, a code of conduct. However it appears that the code is being widely ignored by some surgeons and famous clinics. However, a medical negligence lawyer may be required if something has gone wrong as a result of this. In 2007 Which? Magazine attended the Body Beautiful show in London and found many concerning factors among the different stands. The magazine wrote to the IHAS after finding 20 examples of rule-breaking and bad practice in some promotional materials. No wonder medical negligence lawyers are dealing with an increasing number of claims.

The Harley Medical Group, Make Yourself Amazing (MYA), Linia and Forma were some of those acting outside the ethos of the industry's self-regulatory code. Among these examples, the magazine found:

- Going against the ASA (Advertising Standards Authority) guidelines. Hurlingham clinic and spa gave out a leaflet stating 'rejuvenation is our business". The term "rejuvenation" is generally not acceptable.
- Competitions. Is it appropriate to offer cosmetic treatments as competition prizes?

MYA promoted a competition to win £50 towards a non-surgical procedure or £200 towards a surgical procedure. Linia advertised their competition in which you could win 25% or 50% off an operation. - Comments and endorsements which are prohibited by IHAS guidelines. MYA advertisements included testimonials from Naomi from Channel 4's Shipwrecked 2007. The leaflet also featured former Big Brother contestant, Orlaith McAllister.

Which? health campaigner Frances Blunden pointed out: "Our research shows a cavalier attitude towards the marketing of cosmetic treatments, which is completely unacceptable. We are continually finding examples of irresponsible marketing from some of the biggest and most 'reputable' names in the industry."
